The German Self Employment Visa: What UK Founders Actually Need to Qualify in 2026/27

Setting up a German company is one job. Getting permission to live and work in Germany is another. Plenty of British founders do the first and then hit a wall on the second. The law is short. The hard part is proving your case in a way a German office will trust. Many founders search for a German self-employed visa and find general advice that never covers this. At Lanop, we’ll look at what Germany checks, what proof helps and where UK applicants slip up.

German Self Employment Visa

German Self Employment Visa: The Quick Answer

Germany’s self-employment immigration route is governed by Section 21 of the German Residence Act. Some applicants obtain a national visa before travelling; eligible British citizens can apply for a residence permit after arrival. Commercial founders must show economic interest or regional need, positive economic effects and secure funding. Officials also assess viability and experience. There’s no fixed investment sum, client count or approval formula.

Are You a Commercial Founder or a Freelancer?

Germany sorts self-employed people into two groups. Which group you land in decides the rules you face.

Commercial Self-Employment Under Section 21

Commercial founders generally run a Gewerbe, a registered trade or business. Shops, restaurants, trading companies and many agencies or software businesses may fall into this group. Classification depends on the activity. Commercial self-employment comes under Section 21(1), which carries the full economic tests.

Freelance Activity in Germany

Freiberufler work in Germany’s liberal professions. These can include doctors, architects, engineers, translators and some consultants. UK accountants for consultants can advise on UK obligations, but German classification needs a separate review.

They come under Section 21(5), rather than the full commercial economic tests. They must be able to fund their activity and support themselves. Where a profession is regulated, the required licence or formal assurance of approval is also needed.

Why Getting the Classification Right Matters

The English word “freelancer” doesn’t match the German term Freiberufler. A marketing consultant or a developer may still be seen as commercial. The questions you face can change, and so can the time it takes to settle later. Ask your local immigration office or a chamber of commerce before you write your application.

What Are the German Self-Employment Visa Requirements in 2026?

The Germany self-employed visa requirements sit in Section 21(1). A commercial applicant needs three things:

  • Economic interest or regional demand.
  • A good effect on the economy.
  • Secure funding.

Then the office looks at how well the business can work. It also weighs your experience, the money you put in, the jobs you create and any new ideas you bring.

Economic Interest or Regional Demand

Germany wants to know why its market needs you. Point to local buyers, a gap in supply or a clear regional need. Liking Berlin isn’t a reason.

Positive Economic Impact

Impact can come from jobs, training places, investment, tax or fresh ideas. You don’t have to hire staff. A small consultancy can show impact through sales; local spending and the value clients get.

Secured Business Financing

Funding must be available through your own capital or a committed loan. How much you need depends on the business. A restaurant will usually require more than a solo consultancy.

Business Viability and Founder Experience

Expect the office to ask if you’ve done this work before. Your CV, UK trading record and qualifications all count here. The plan must also show the business can pay your way without public money.

The German Self Employment Visa: What UK Founders Actually Need to Qualify in 2026/27

Do You Need German Clients to Qualify?

No law asks for exactly two or three German customers. If someone quotes you a number, they’re guessing. German proof does help, though. It makes your case for local demand far easier to believe.

German Contracts, LOIs and Customer Enquiries

A signed contract shows firm demand. A detailed letter of intent (LOI) shows real interest. A casual enquiry shows the least. The stronger the proof, the more it counts, but nothing here guarantees a result.

Can UK and International Clients Count?

Yes. Foreign contracts show your business earns real money and your service sells. They can’t show that Germany needs you. For that, explain why you’ll serve German buyers or why moving there helps the business.

How Much Money Do You Need for a German Self-Employment Visa?

You need enough to run your business. So, Germany self-employment visa funding is a planning job, not a number you can copy from a blog.

Is There a Minimum Investment?

No. Section 21 sets no single amount for everyone. The office checks if your funds fit your business and if you can support yourself.

The €25,000 GmbH Myth

GmbH share capital is a company law requirement, not a visa threshold. A GmbH has €25,000 in registered share capital, although a cash-funded company can generally be registered with at least €12,500 paid in, subject to contribution rules. Don’t confuse that with business launch money or personal living funds.

GmbH Share Capital Business Launch Funding Personal Living Funds
€25,000 registered share capital; for a cash-funded GmbH, usually at least €12,500 paid in to register Money to start and run the business Money to live on while the business grows
Set by company law Judged against your business model Judged against your household costs

A UG is the lower-capital option. It may start with as little as €1 of share capital, paid in full before registration, and must build up statutory reserves from profits. Neither figure says what your visa case needs.

How Much Funding Is Enough?

Match the money to the model:

  • Solo consultancy: low setup costs, but a long runway.
  • Online agency: software, marketing and freelancers.
  • Restaurant: premises, a fit-out, licences and staff.
  • Shop: stock.
  • Tech startup: development costs and months with no sales.

Build your figures from your own costs.

What Must Your German Self Employment Visa Business Plan Prove?

Your plan has one big job. It must show why Germany should believe this business will work.

Section 21 does not prescribe one standard business plan format or length. But the German Missions ask for a business plan, finance and liquidity plans, and a revenue or profitability forecast. This evidence sits at the heart of your application.

A German-language plan, or a professional translation, can help local reviewers. Check the language and document rules with the authority handling your application; translation is not one universal statutory requirement.

German Market Demand and Customer Need

Show who buys, why they buy and how you know. Customer talks, LOIs, price tests and market data all help.

Founder Experience and Ability to Deliver

Tie your past work to this business. If your CV and your plan don’t match, the office will ask why.

Commercial Model, Pricing and Competitors

Say how you make money and why buyers pick you. Name real rivals. Claiming you have none rarely convinces anyone.

Funding and Operational Plan

Show where the money comes from and where it goes. Cover premises, tools, staff, suppliers and dates.

Economic Benefit to Germany

Say what you’d bring, whether that’s jobs, tax, training, investment or new ideas. Keep every claim realistic.

Risks and Contingency Planning

Name your real risks, such as slow sales or losing a key client. Then say how you’d cope. An honest risk section earns trust.

What Financial Forecasts Should UK Founders Prepare?

Start with three core documents:

  • A revenue forecast.
  • A profit and loss forecast.
  • A monthly cash flow (liquidity) plan.

Add startup costs and monthly running costs. Include your own drawings, staff costs if you have staff, and break-even points. Finish with a downside case in which sales come late.

Unrealistic numbers can weaken your case. Support forecasts with realistic assumptions, actual customer evidence and costs you can explain. That’s why early financial planning matters.

Can Your Existing UK Business Strengthen the Application?

It can. UK accounts, trading history, contracts, repeat buyers and references all show you know how to run a business.

There’s a catch. A successful UK company doesn’t prove your German plan meets Section 21. The office will still ask, “Why Germany?” Have a clear answer and the proof to back it up.

What Happens to Your UK Ltd If You Move to Germany?

Moving you and moving your company are two different choices. Get tailored tax advice before you act. The outcome depends on your facts, and this is the kind of question dedicated tax planning exists to answer.

Keeping the UK Company

Many founders keep the Ltd for their UK clients. But where you live, and where the company is run from, can change how it’s taxed. Don’t assume nothing will shift.

German Subsidiary or Branch

A UK company can own a German company. It can also open a German branch. Each route brings different reporting, liability and tax effects. Our group structuring service can help you weigh them up.

Cross-Border Accounting, VAT and Payroll

Operating across two countries can create extra filings, but not every business needs every filing in both. Review your cross-border accounting, VAT position and any German payroll obligations against the structure and activities you have.

Tax and Management Considerations

Look at where key decisions are made, where people work, who signs contracts and where the business has a presence. These facts can affect tax residence, permanent establishment and reporting in either country.

Do You Need a GmbH Before Applying?

Not automatically. Forming a company is a matter of company law. A residence permit is permission to live and work. A GmbH won’t give you residency by itself. And a German company with no real business case won’t carry your application.

Some founders apply first and form the company later. Others register it earlier to support the plan. Local immigration authorities may ask for company documents or proof that formation is underway. Your UK trading record may help but check the local evidence list before you commit.

GmbH UG German Branch of a UK Company
A private limited company with €25,000 registered share capital (usually at least €12,500 paid in for cash formation). Liability is generally limited. A smaller version of the GmbH with lower starting capital. It must build up reserves from profits over time. An extension of your UK company with no separate share capital. It stays tied in law to the UK parent.

What Documents Should UK Founders Prepare?

Your Germany self-employment visa documents depend on the office, your case, your trade and your business. Most files include the following:

  • Personal documents: the application form, your passport, photos, and proof of where you live.
  • Business plan: the complete plan, with a German translation where the authority requires one.
  • Market demand: research, a check on your competitors, and anything that shows real customers want your product.
  • Contracts and LOIs: signed deals, plus letters of intent from people who plan to buy.
  • Funding: bank statements, loan offers, or letters from investors backing you.
  • Financial projections: what you expect to earn, your profit and loss, and how you’ll keep enough cash in the business.
  • UK business proof: accounts, tax returns, invoices, and references from past clients.
  • CV and qualifications: certified translations are needed in some cases.
  • Health insurance: evidence of cover that meets German requirements.
  • Company records: Companies House extracts, shareholder details, and any German registrations you already have.
  • Licenses: trade permits, or proof your profession is recognized, if your line of work requires it.

Make sure figures and dates match across every document.

Can UK Citizens Enter Germany First and Apply There?

British citizens can generally travel to Germany without a visa and apply for a Section 21 residence permit there. The German Missions say you must register your address (Anmeldung) within two weeks of moving in and apply for your residence permit within the first 90 days. Contact the local immigration office early to arrange the application.

This option is not available simply because someone lives in the UK. Other UK residents and holders of other British nationalities should check whether they need a visa before travelling.

The 90 Day Rule for UK Founders

Visa-free visits generally allow up to 90 days in any 180-day period. Some business meetings, negotiations and other limited activities may be permitted, depending on the circumstances. But visa-free entry does not normally allow you to start operating a self-employed business in Germany.

Can You Work While Your Application Is Pending?

Permission to enter, stay and work are separate. If you apply lawfully and on time, Section 81(3) may allow you to remain in Germany while the office decides. It does not by itself give you permission to start self-employed work. Wait for a visa or permit that explicitly authorises the activity.

Apply From the UK or After Arriving in Germany?

Factor Apply From the UK Apply After Arriving
Starting work From the first day of a valid visa expressly allowing self-employment Once a residence permit expressly allows self-employment
Certainty about the move You move with a decision in hand You move before you know
Processing risk You wait at home You wait in Germany
Living costs while waiting Your UK costs carry on German rent and insurance start
Planning Easier to put in order Needs a bigger cash buffer

Neither route wins every time. Check the permit conditions, likely wait and living costs before choosing where to apply.

How Long Does the German Self-Employment Visa Take in 2026?

Expect months. The German Missions UK page for entrepreneurs says this category can take several months, even up to a year, depending on how complex the project is. Their freelancer page says most cases take six to nine months.

So, treat the Germany self-employment visa timeline as a range, not a promise.

Delays come from several places:

  • Complex business models.
  • The local immigration office.
  • Chamber reviews.
  • Missing papers.
  • Follow-up questions.
  • Regulated sectors.

How Much Financial Runway Should You Plan?

There’s no official minimum, so plan around your own life. Budget for housing, health insurance and daily costs. Add translations, professional fees, business setup, accounting and compliance. Expect slow sales and keep a reserve on top.

Try this test. Could you cover twelve months of waiting if you had to? Answer that honestly before you move.

Your German self-employment visa cost is more than the application fee. Official fees change, so check the current German Missions page.

The German Self Employment Visa: What UK Founders Actually Need to Qualify in 2026/27

Do You Need German Employees to Qualify?

No. The office may look at the jobs you create, but no rule makes every founder hire a set number. Solo founders can qualify when other strengths show value.

Don’t invent a hiring plan to look good. An unrealistic plan damages your credibility.

What Other Technical Requirements Can Affect Your Application?

Pre-Revenue and Low-Cost Businesses

With little or no revenue, proof of demand, funding and your own experience matter more.

Regulated Professions and Business Licences

A residence permit doesn’t replace a professional licence or recognition. Check the rules for your sector.

Applicants Over 45

Under Section 21, applicants older than 45 generally need adequate retirement provision. The required proof depends on the case and local office. Settlement permits have separate conditions, so think about retirement funding alongside wider estate and financial planning.

Health Insurance for Your Residence Permit

Germany requires sufficient health insurance. Prepare evidence of cover acceptable for a German visa or residence permit, and allow for the cost in your personal budget.

Can You Get Permanent Residence?

A Section 21 self-employment residence permit is issued for up to three years. Commercial founders may qualify for settlement after three years if the business is successful and the other conditions are met. Freelancers under Section 21(5) do not use this accelerated route and generally follow the five-year settlement rules. Approval is not automatic.

Frequently Asked Questions

Yes. UK citizens can apply if they meet the Section 21 requirements. Germany looks at business demand, funding, viability and the founder’s experience.

The law sets no fixed number. German contracts, letters of intent, enquiries or partnerships can help prove real demand in the German market.

Generally, yes, if you are a British citizen. Apply for your residence permit within 90 days of arriving and register your address after moving in. You cannot start self-employed work until your visa or residence permit expressly allows it.

Only if your existing immigration permission explicitly authorises that activity. A timely residence-permit application may let you stay while it is assessed, but it does not automatically let you start working.

No timeline is guaranteed. Cases can take several months, especially when officials need extra documents, business plan reviews or input from local economic bodies.

We're a small company in business for 23 years. We've been with Lanop for over a year now. From the outset they listened carefully to our somewhat complex bookkeeping needs (we sell products and services with different tax codes); they've provided a tailored solution that they execute with precision and in a timely manner. We hired them to provide combined bookkeeping, payroll and accountancy service, and they're a dream to work with on all aspects. They are careful and conscientious, and never last minute. Excellent measured responses when I ring up with questions - always so friendly, too. The price is very reasonable, not least given the high standard of service and the peace of mind we have. Top drawer.

I'm in the early stages of a startup and got in touch with Lanop, who looked to be very knowledgeable in my niche. I booked a 30-minute consultation with Muhammad, who was great and understood all the challenges i'd be facing and what direction i need to go. I was very impressed with his advice, and i came away with confidence and reassurance that this is someone i need to be working with as i scale up.

I was so lost in the woods with taxes and accounts, and on top of that, I had a limited company I was eager to get off my hands. Lanop was fabulous from start to finish and got everything taken care of. I went from being a bundle of nerves about anything financial to feeling totally at ease. I never thought I'd see the day! Everything occurred in a timely manner and I was always updated on everything that was going on, which was lovely. I was also quoted really fairly for everything as well! Above all else, Lanop gave me incredible peace of mind. If you work with them, you'll certainly be in good hands.
